Kafala System
نظام الكفالة
Definition
The Kafala (sponsorship) system is a framework used in Saudi Arabia and other Gulf states that ties a foreign worker's immigration status to their employer-sponsor (kafeel). Recent reforms under the Labor Reform Initiative (2021) have loosened some restrictions, allowing workers to change jobs and exit the country without employer consent.
Why Kafala System Matters in Saudi Arabia
Understanding Kafala System is essential for any business operating in Saudi Arabia. The Kingdom's Vision 2030 economic transformation plan places heavy emphasis on labor market reform and nationalization. Companies that fail to comply with employment regulations face significant penalties including fines, service suspension, and visa blocks. Whether you are an HR manager, business owner, or employee, mastering this concept helps ensure compliance and operational continuity in the Saudi market.
Key Reforms (2021–2025)
- Job mobility: Workers can transfer to a new employer after completing their contract or after 1 year
- Exit/re-entry: Workers can travel without employer permission
- Final exit: Workers can leave the country without employer consent
Despite reforms, the employer still sponsors the worker's Iqama and is responsible for renewal fees. Use our Iqama Renewal Calculator to estimate sponsorship costs.
